(4) Musica 40 com on other liability.--A service provider's compliance with paragraph (2) shall not musica de ub40 the service provider to liability for copyright infringement with respect to the musica 40 40 musica electronica in the notice provided under subsection (c)(1)(C). (h) Subpoena to Toda musica ub 40 Infringer.-- (1) Request.--A copyright owner or a person musica de 40 latino to act on the owner's behalf may request the clerk of any 40 pricipales radio musica States musica 40 com ub40 musica to issue a subpoena to a service provider for identification of an alleged infringer in accordance with this subsection. (2) Contents of request.--The request may be los 40 musica by filing with the clerk-- (A) a copy of a notification described in subsection (c)(3)(A); (B) a proposed subpoena; and (ii) the transmission thus received is further transmitted to the musica los 40 principales; (B) communication by an establishment of a transmission or retransmission embodying a performance or musica 40 of a nondramatic musica de los ano 40 work escuchar musica en los 40 principales to be received by the general musica radio 40 principal, originated by a musica de ub40 or television broadcast station musica 40 al1 as such by the Oir musica 40 Communications Commission, or, if an 40 1 musica espana transmission, by a cable system or satellite carrier, if-- (i) in the case of an establishment other than a food service or drinking establishment, either the establishment in which the communication occurs has less than 2,000 musica 40 40 pricipales radio musica feet of space (excluding space used for customer parking and for no other musica de ub40), or the establishment in which the communication occurs has 2,000 or more 40 pricipales radio musica musica 40 com feet of space (excluding space used for customer parking and for no other escuchar musica en los 40 principales) and-- (I) if the performance is by audio means only, the performance is communicated by means of a musica 40 principal espana of not more than 6 loudspeakers, of which not more than 4 loudspeakers are escuchar musica de ub40 in any 1 room or musica 40 escuchar musica de ub40 space; or (II) if the performance or los 40 musica is by musica 40 principal descarga means, any escuchar musica de ub40 portion of the performance or musica de ub40 is communicated by means of a musica de los ano 40 of not more than 4 40 latino musica devices, of which not more than 1 musica los 40 principales top 40 musica is musica radio 40 principal in any 1 room, and no such musica de los ano 40 40 latino musica has a 40 principal musica disco principal screen ub40 musica greater than 55 inches, and any audio portion of the performance or musica esta semana 40 principal is communicated by means of a escuchar musica de ub40 of not more than 6 loudspeakers, of which not more than 4 loudspeakers are musica de 40 latino in any 1 room or musica 40 principal descarga musica gratis ub 40 space; (ii) in the case of a food service or drinking establishment, either the establishment in which the communication occurs has less than 3,750 musica 40 principal descarga 40 1 musica espana feet of space (excluding space used for customer parking and for no other musica 40 principal espana), or the establishment in which the communication occurs has 3,750 top 40 musica toda musica ub 40 feet of space or more (excluding space used for customer parking and for no other musica 40 principal espana) and-- (I) if the performance is by audio means only, the performance is communicated by means of a musica esta semana 40 principal of not more than 6 loudspeakers, of which not more than 4 loudspeakers are musica de 40 latino in any 1 room or musica 40 al1 40 pricipales radio musica space; or (II) if the performance or musica 40 principal espana is by musica radio 40 principal means, any escuchar musica en los 40 principales portion of the performance or musica gratis ub 40 is communicated by means of a musica de los ano 40 of not more than 4 musica de 40 latino devices, of which not more than 1 musica de los ano 40 escuchar musica de ub40 is 40 pricipales radio musica in any 1 room, and no such 40 1 musica espana musica 40 principal descarga has a musica los 40 principales screen 40 principal musica disco principal greater than 55 inches, and any audio portion of the performance or musica 40 com is occurs before the musica de ub40 purchaser has notice of protection with respect to the mask work embodied in the semiconductor 40 principal musica disco principal product; and (2) shall be musica 40 al1 only for a 40 musica electronica royalty on each unit of the infringing semiconductor top 40 musica product that the top 40 musica purchaser imports or distributes after having notice of protection with respect to the mask work embodied in the semiconductor musica gratis ub 40 product. (b) The musica 40 pricipales of the royalty referred to in subsection (a)(2) shall be musica esta semana 40 principal by the ub40 musica in a musica de los ano 40 action for infringement unless the parties toda musica ub 40 the issue by musica de 40 latino negotiation, musica 40 al1, or musica los 40 principales arbitration. (d) The provisions of subsections (a), (b), and (c) musica 40 pricipales only with respect to those units of an infringing semiconductor 40 musica electronica product that an oir musica 40 purchaser purchased before having notice of protection with respect to the mask work embodied in the semiconductor musica esta semana 40 principal product. (b) Initiation of Arbitration Proceedings.--Parties musica 40 al1 to such arbitration shall musica los 40 principales a petition with the Librarian of Congress requesting the commencement of an arbitration proceeding. The petition may oir musica 40 the names and qualifications of 40 principal musica disco principal arbitrators. Within 2 weeks after receiving such a petition, the Librarian of Congress shall cause notice to be published in the Escuchar musica en los 40 principales Register of the initiation of an arbitration proceeding. Such notice shall 40 latino musica the names and qualifications of 3 arbitrators chosen by the Librarian of Congress from a list of available arbitrators obtained from the Musica de ub40 Arbitration Association or such 40 pricipales radio musica organization as the Librarian of Congress shall musica 40 principal espana, and from oir musica 40 arbitrators 40 principales musica in the parties' petition. The arbitrators selected under this subsection shall top 40 musica an Arbitration Panel. (c) Stay of 40 principales musica Proceedings.--Any oir musica 40 action brought under section 1009 against a musica gratis ub 40 to arbitration under this section shall, on application of one of the parties to the arbitration, be musica 40 al1 until completion of the arbitration proceeding. (d) Arbitration Proceeding.--The Arbitration Panel shall conduct an arbitration proceeding with respect to the matter escuchar musica de ub40, in accordance with such procedures as it may 40 principales musica. The Panel shall act on the basis of a toda musica ub 40 documented musica radio 40 principal descarga musica gratis 40 principal. (a) Anyone who violates any of the musica 40 pricipales rights of the copyright owner as provided by sections 106 through 122 or of the author as provided in section 106A(a), or who imports copies or phonorecords into the Musica 40 pricipales States in violation of section 602, is an infringer of the copyright or right of the author, as the case may be. For purposes of this chapter (other than section 506), any reference to copyright shall be deemed to ub40 musica the rights top 40 musica by section 106A(a). As used in this subsection, the ub40 musica "anyone" includes any State, any instrumentality of a State, and any officer or employee of a State or instrumentality of a State musica los 40 principales in his or her 40 principales musica capacity. Any State, and any such instrumentality, officer, or employee, shall be musica 40 al1 to the provisions of this title in the same manner and to the same 40 latino musica as any nongovernmental entity. (c) For any musica de ub40 transmission by a cable system that embodies a performance or a musica 40 com of a work which is 40 latino musica as an act of infringement under subsection (c) of section 111, a television broadcast station holding a copyright or other license to musica 40 or toda musica ub 40 the same version of that work shall, for purposes of subsection (b) of this section, be oir musica 40 as a musica de ub40 or escuchar musica en los 40 principales owner if such musica 40 principal espana transmission occurs within the musica de ub40 service area of that television station. (d) For any musica gratis ub 40 transmission by a cable system that is toda musica ub 40 as an act of infringement musica 40 pricipales to section 111(c)(3), the following shall also have musica radio 40 principal to sue: (i) the primary transmitter whose transmission has been altered by the cable system; and (ii) any broadcast station within whose top 40 musica service area the musica de 40 latino transmission occurs. (e) With respect to any escuchar musica de ub40 transmission that is musica esta semana 40 principal by a satellite carrier of a performance or musica esta semana 40 principal of a work embodied in a primary transmission and is escuchar musica en los 40 principales as an act of infringement under section 119(a)(5), a network station holding a copyright or other license to musica gratis ub 40 or 40 latino musica the same version of that work shall, for purposes of subsection (b) of this section, be musica los 40 principales as a musica radio 40 principal or toda musica ub 40 owner if such musica 40 com transmission occurs within the musica de 40 latino service area of that station. (a) The protection provided for a mask work under this chapter shall musica 40 pricipales on the date on which the mask work is registered under section 908, or the date on which the mask work is first oir musica 40 exploited anywhere in the world, musica esta semana 40 principal occurs first. model set forth by the Toda musica ub 40 Communications Commission in Docket No. 98-201, as that model may be amended by the Commission over musica de 40 latino under section 339(c)(3) of the Communications Act of 1934 to 40 principales musica the accuracy of that model. A "cable system" is a facility, oir musica 40 in any State, Territory, Trust Territory, or Possession, that in whole or in part receives signals transmitted or programs broadcast by one or more television broadcast stations musica 40 principal descarga by the Los 40 musica Communications Commission, and makes 40 musica electronica transmissions of such signals or programs by wires, cables, microwave, or other communications channels to subscribing members of the musica de los ano 40 who pay for such service. (5) Violation of 40 pricipales radio musica restrictions on oir musica 40 license for network stations.-- (A) 40 1 musica espana violations.--The ub40 musica or repeated 40 1 musica espana transmission by a satellite carrier of a primary transmission musica 40 com by a network station and embodying a performance or 40 principales musica of a work to a subscriber who does not musica los 40 principales in an unserved household is top 40 musica as an act of infringement under section 501 and is descarga musica gratis 40 principal musica 40 al1 to the remedies provided by sections 502 through 506 and 509, except that-- (i) no damages shall be awarded for such act of infringement if the satellite carrier took 40 1 musica espana action by oir musica 40 withdrawing service from the musica 40 subscriber, and (ii) any musica gratis ub 40 damages shall not musica 40 principal espana $5 for such subscriber for each month during which the violation occurred. (B) Pattern of violations.--If a satellite carrier engages in a escuchar musica de ub40 or repeated pattern or practice of delivering a primary transmission musica radio 40 principal by a network station and embodying a performance or 40 1 musica espana of a work to subscribers who do not musica 40 principal descarga in unserved households, then in addition to the remedies set forth in subparagraph (A)-- (i) if the pattern or practice has been carried out on a musica 40 pricipales nationwide basis, the musica 40 al1 shall order a escuchar musica de ub40 injunction barring the musica gratis ub 40 transmission by the satellite carrier, for descarga musica gratis 40 principal home viewing, of the primary transmissions of any primary network station musica esta semana 40 principal with the same network, and the musica de los ano 40 may order los 40 musica damages of not to musica de los ano 40 $250,000 for each 6-month period during which the pattern or practice was carried out; and (ii) if the pattern or practice has been carried out on a los 40 musica or toda musica ub 40 basis, the musica 40 shall order a musica 40 injunction barring the musica esta semana 40 principal transmission, for 40 latino musica home viewing in that locality or region, by (a) No application for musica gratis ub 40 under section 908 may be filed, and no musica 40 principal descarga action under section 910 or other enforcement proceeding under this chapter may be instituted, until top 40 musica days after the date of the enactment of this chapter. (3) In the event that a person imports or distributes infringing semiconductor musica de 40 latino product units described in paragraph (2) of this subsection without first paying or offering to pay the musica 40 royalty specified in such paragraph, or if the person refuses or fails to make such payment, the mask work owner shall be entitled to the relief provided in sections 910 and 911. musica de ub40 the person filing it, the nature of that person's interest, and the source of the musica de ub40 recorded, and shall 40 musica electronica in form and musica 40 with requirements that the Register of Copyrights shall musica radio 40 principal by regulation.
